Terms & Conditions
To avoid confusion, we believe it is in your own interest to understand how our wedding list service operates. Our terms and conditions (incorporating the wedding list procedures) are set out below:
In these terms and conditions The Elms Wedding List is variously referred to as “The Wedding List”, “our” “we” or “us” and the client is referred to as “client” “you” or “your”. Please note that your agreement is with The Elms Furniture Ltd, Watch House Crossroads, Punchestown, Naas, Co. Kildare P. 00353 45 876060, Reg. Company No. 432438, IE9642652G
The wedding list procedure is set out at Schedule A and forms part of these terms and conditions. In the event of any contradiction between the wedding list procedure and these terms and conditions, then these terms and conditions shall prevail.
Changes of address including email address and telephone numbers, additions and amendments to your wedding list and all notices from you to us must be made in writing (including email). Additions and amendments to the wedding list will be accepted provided the items concerned have not already been selected, ordered or reserved.
We regret that specific items that have been specially ordered from a supplier for you as specified on your wedding list may not be changed or returned once the supplier has dispatched said order to us.
Gifts that have been reserved by guests by telephone and paid for by cheque will not be notified to you until the cheque is received by us. Guests are able to come into store to select a gift from your wedding list. They will not be able to take the gift away with them but it will be delivered with your other gifts after the wedding. Sale or promotional discounts in The Elms will not be available to your guests.
You will be notified of selections made from your wedding list by email.
Our aim is to make the first delivery to you, which may be a part shipment, between approximately two to six weeks from the date of your wedding. However, it should be understood that the order of some items may take suppliers several months to process and deliveries from suppliers can be delayed. Where this occurs we will endeavour to notify you and advise you of the expected delivery time but we cannot be held responsible for any delays or misinformation by suppliers.
We regret we cannot guarantee the availability of any item on your wedding list. If an item becomes unavailable, you will be required to make an alternative choice. You should understand that it is not always possible to advise that an item is not available at the time you place an order.
Prices quoted on the list will neither be increased nor decreased. We are unable to include any merchandise at sale or promotional prices on your wedding list.
Every delivery is accompanied by an itemised delivery note. If the gifts we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address of the problem within ten working days of the delivery of the gifts in question. Any authorised return to the store will be ordered directly from the supplier and will not be taken from the shop floor. Items purchased by a guest from the shop floor separate to the wedding list service will not be the responsibility of The Elms.
Your guest will be able to obtain points against their Pink Privilege Card at the time of Purchase for sales made in store only. You will only be able to obtain points on your Pink Card for future purchases, unrelated to your wedding list.
At the purchasing stage, should you wish to specify alternative gifts not itemized on your original wedding list, changes are only accepted if available from one of our approved suppliers. All monies received from your guests must be allocated to your wedding list and no cash payments or refunds will be made to you.
We will store your wedding presents without charge for up to eight weeks from the date of your wedding, following which you will have to pay a storage charge.
We require at least ten working days’ notice to arrange delivery. We allow two free delivery services per wedding list within the Republic of Ireland and Northern Ireland.
Upon signature of these terms and conditions, we reserve the right in the event of your wedding being cancelled, to charge an administrative fee of the greater of €500 or 10% of the value of the gifts purchased by guests at the time of the cancellation subject to a maximum charge of €750. Upon receipt of this payment from you, all guests will be refunded the amount of their gift and will be advised in writing that a credit has been issued.
In the event of any act or circumstances beyond the company’s reasonable control, including but not limited to any failure on the part of our suppliers, Act of God, legislation, war, flood, fire, drought, break-in, theft, any failure in the delivery service we use, failure of power supply, lock out or strike we shall have no liability to you for any delay or failure to deliver the goods.
Nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
Save as precluded by law:
The Elms total liability in contract, tort (including negligence or breach of statutory duty) misrepresentation or otherwise, arising in connection with the performance or contemplated performance of these terms and conditions will be limited to the value of your wedding list; and
The Elms shall not be liable to you for any indirect or consequential loss or damage (whether for loss of profit, loss of business, completion of goodwill or otherwise), costs, expenses or other claims of consequential compensation whatsoever (howsoever caused) which arise out of or in connection with the performance of these terms and conditions.
The contract between us shall be governed by Irish Law and the Irish Courts shall have jurisdiction to resolve any disputes between us.
These terms and conditions, and the documents referred to in it, constitute the entire agreement and understanding of the parties and supersede any previous agreement between the parties relating to the subject matter of these terms and conditions.
In our normal course of business your contact details will be used by The Elms in order for you to be added to its customer records. If you do not wish this to occur, please tick here .
We confirm we have read, understood and undertake to follow the terms and conditions listed above during the administration of our wedding list.
It should be noted that a wedding list cannot be created until we are in receipt of your signed terms and conditions.
Schedule A- The Elms Wedding List Procedure
Terms and Conditions given to client by consultant of The Elms (“consultant”) and signed by client.
Wedding list created between client and consultant in store.
Consultant requests written acceptance of wedding list from client.
Client made aware of specified communication method – email.
Wedding list goes live on website www.theelms.ie
Hard copy version of Wedding List posted to client with 4 working days of in store consultation.
Guests make selection from wedding list.
Notification of gifts when payment received sent out weekly via email.
After wedding client receives selected list of purchases made and is offered remaining gifts on list at an agreed discounted rate.
Client will have 90 days from date of wedding for exchange/return.
Wedding gifts received by The Elms and despatched to the client.
